A father and son have been arrested and charged with aggravated assault. Cleveland Clay Bain, 67, and his son Clay Andrew Bain, 29, both of Smithville were arrested after an incident which took place on Jan. 25.
Sherriff Patrick Ray said Cleveland Bain was arrested on Jan. 26 and charged with one count of aggravated assault after he struck a victim in and about the head with a rock. The victim suffered serious injury to his head, face and back during the attack. The son, Clay Bain, was charged with two counts of assault after showing a gun and a knife during the attack, causing someone to fear for their life. The younger Bain was also cited for possession of less than half ounce of marijuana. Cleveland Bain’s bond was set at $20,000, while Clay Bain’s bond was $30,000. They are both to appear in court April 8, 2021 to answer to the charges.
