A man who had sex with a 16-year-old girl received a two-year sentence on Statutory Rape charges last week in DeKalb Criminal Court, all suspended to TDOC probation with 114 days credit for time served.

Guadalupe Franz Aguilar-Estrada, 24, of Smithville, made the plea on January 29, and had been incarcerated for the crime from October 6, 2023 to January 29, 2024. The crime was committed on August 5, 2023, and was investigated by a DeKalb Sheriff’s Department detective.

In other Criminal Court news, 22-year-old Christopher Edward Murphy-Spoon, Jr. entered a guilty plea to possession of a schedule II drug (methamphetamine under 0.5 grams for sale) and aggravated assault. He received a six-year sentence, all suspended to supervised probation.

He was fined $2,000 in the drug case and was ordered to make restitution of $40,000 to the DeKalb County Sheriff’s Department in the assault case jointly and severable with two co-defendants. He was given jail credit of 117 days. The sentences are to run concurrent with a Warren County case.

Sheriff Patrick Ray told the Smithville Review that on October 26, 2023, 24-year-old Gabriel James Hesson of Oak Drive, Smithville, and Spoon were arrested for aggravated assault. Sheriff’s officials allege that on October 20, 2023, Hesson and Spoon knowingly and intentionally caused serious bodily injury to a male inmate at the DeKalb County Jail. Authorities allege that Hesson struck the inmate in the face multiple times with a closed fist. Spoon was observed striking the inmate multiple times while he was on the ground.

All three men were incarcerated in the jail at the time of that assault, and the fight was observed by a camera, while officers responded to the annex cell to stop the incident. According to the video footage, Hesson was observed striking the inmate first and continued striking him multiple time, causing broken bones, abrasions, and swelling on his face.

Mario Castandeda Garcia, 57, pled guilty to DUI 2nd offense and received 11 months, 29 days, all suspended to CPS probation except for 45 days to serve. The sentence may be served in a DUI center and rehab. He was fined $600.

Timothy William Patrick, 35, pled guily to possession of a schedule II drug (methamphetamine over 0.5 grams for sale) and received an eight-year sentence as a range I offender. A sentencing hearing will be held to determine the manner of service. He has been given jail credit of 405 days.

Bradley John Baker, 56, pled guilty to attempted sale of a schedule II drug (methamphetamine) and received a four-year sentence all suspended to TDOC probation, and a $2,000 fine. The sentence is to run concurrent with another case against him and he received five days jail credit.

Timothy Leon Summers, 58, pled guilty to over $1,000 of vandalism at Tennessee Credit Union for a case that occurred on July 29, 2019. He received 11 months, 29 days of supervised probation, and the court will consider a motion for unsupervised probation after payment of $4,000 in restitution is paid in full.

Kimberly Ward, 42, pled guilty to first offense DUI and was sentenced to 11 months, 29 days, all suspended except for 48 hours to serve. She lost her license for one year and has been fined $300.
